Italian watchdog claims OpenAI's ChatGPT violates privacy regulations

As it moves on with an inquiry that was launched last year, Italy’s data protection regulator has informed OpenAI that their artificial intelligence chatbot program ChatGPT violates data protection regulations. The watchdog made this announcement on Monday.

One of the most proactive agencies in the European Union for determining whether AI platforms adhere to the bloc’s data protection regulations is Garante. It suspended ChatGPT last year due to suspected violations of EU privacy regulations.

After OpenAI resolved concerns about, among other things, users’ rights to refuse to consent to its use of personal data to train its algorithms, the service was later reactivated.

The agency declared at the time that it will carry out more inquiries. It has since come to the conclusion that certain aspects point to one or more possible violations of data privacy, it stated in a statement without going into further detail.

An instant response was not received from OpenAI regarding a comment.

The Garante said on Monday that OpenAI, which is supported by Microsoft, has 30 days to submit defense arguments. It also stated that the work of a European task force made up of national privacy watchdogs will be considered in the probe.

Legislators and authorities have taken notice of ChatGPT because of its rapid development, with Italy being the first nation in West Europe to prohibit it.

Any business found to be in violation of the EU’s General Data Protection Regulation (GDPR), which went into effect in 2018, might be fined up to 4% of its global sales.

We’ve come a long way toward establishing regulations controlling AI systems, like ChatGPT, since EU governments and parliamentarians agreed on interim parameters in December.
